Chapter 7

Chapter 7 bankruptcy quickly frees you from debt and is primarily used to get rid of unsecured debt, like medical bills or credit cards. You may keep your car or home if you choose to do so, if you are current on the payments when you file. We use bankruptcy to stop garnishments, repossessions, and lawsuits, and additionally allow you to get rid of cars or houses that you no longer wish to pay for. Chapter 13

Chapter 13 also stops garnishments, lawsuits, foreclosures, and repossessions, but we frequently use Chapter 13 as an opportunity to save our clients’ homes from foreclosure and cars from repossession. In many of these cases, all debt payments, even car payments, are included in a plan payment, which sometimes less than the original car payment. Only a very small part of the unsecured debt is repaid in a typical Chapter 13 case.
